Ms F’s Story

Ms F has cerebral palsy due to complications at birth. A compensation settlement was agreed during her childhood with the expectation that she would always require 24h care and likely remain living with her parents as long as they were able to support her. When JE Bennett became involved taking over as Ms F’s Court Appointed Deputy it was clear that she had surpassed these expectations and wanted a more independent life.

Unfortunately, Ms F discovered that her family were not supportive of her goals for greater independence and at this time were living in a property that was owned by Ms F. At the time of my involvement Ms F in combination with her case manager and JE Bennett Law were already looking for options to find a way for her to remain living in her home independently. A direct approach had failed and Ms F’s family were not willing to move out, citing that she would not be able to live in the independent manner that she aspired to. This impasse was causing Ms F a great deal of distress and had left her feeling very trapped and unsupported.

JE Bennett Law were instrumental in supporting Ms F with a different approach that would give her the opportunity to demonstrate that she was able to live more independently. With input from Ms F and her case manager they were able to secure a local rental property which Ms F moved into with an appropriate care package. Over the following months Ms F was able to reduce the amount of care input that she required and demonstrate her ability to live in a more independent and age appropriate manner.

Sadly, Ms F’s family remained living in her home and offered no financial compensation for doing so. This situation continued to cause Ms F great distress and her relationship with her family broke down. At this point JE Bennett Law were able to maintain communication with her family and take appropriate steps with the Court of Protection in order to ensure that her family vacated the property. This was a complex task but I believe JE Bennett Law advocated very effectively for their client who has now been able to return to her home and continue her progress as a young adult.
